What is probate?

When someone dies you must obtain the legal right to deal with their estate from the Probate Registry.

However, in some cases when the estate is worth less than £5,000 you may not contact usneed to obtain a grant from the Probate Registry, as it is classed as a small estate.

If the deceased left a will then you would apply for a Grant of Probate.

If the deceased did not leave a will then you would apply for a Grant of Letters of Administration.

What is a grant of probate?

The grant of probate is a document which states who has been nominated to deal with the deceased's estate. E.g. an executor in a will or a personal representative of the deceased's estate, who did not make a will.

The grant of probate then allows the executors/ personal representative to collect the estate's assets and pay off any debts, then administer the estate, as per the will or intestacy rules.

In the event that there is a dispute over the deceased's will then we can also guide you to stop the issue of a grant and deal with any disputes.
